  • Perch Capital TMLEGAL are trying to obtain a 2nd CCJ on a MyJar loan

    Hello, I知 new to the forum and really hoping for some advice and guidance.

    I got a CCJ on January 15, 2018. It was for a payday loan with MyJar. At some point MyJar went out of business and sold the debt to Perch. I have been contacted earlier this week by TMLegal by text, telling me they were handling my debt. Two days later, I got a text from TM that said legal proceedings have been issued against me. The same day I got a court claim form in the post of a CCJ from Perch. I then got a Letter of Claim from TMLegal. The court claim form is dated May 9th. The letter from TML is dated May 4th, even though I got it after the court form. By reading posts on this forum, I found that I needed to acknowledge the claim with the court which I did.

    PLEASE, WHAT DO I DO NEXT? I didn稚 think you could get a 2nd CCJ for the same debt. The first CCJ is 5 years and 3 months old. I知 so confused about what to do. I知 a vulnerable adult. I have ADHD, depression and anxiety. I feel that I have the potential to really mess this up. I知 scared and don稚 know what to do beyond what I have already done.

    Do you still have a copy of the 2018 judgement? Or at least details including the claim number?

      Yes, I have the case ID Number as shown on my credit report.

        Then file a defence which says that judgement has already been given against you in respect of this debt, in case no. *******, and that this second claim should therefore be struck out.
