    Well done! Thanks for updating the forum and providing the judge's comments which will I am sure be very useful for the next defendant who posts about facing a claimant intending to lift a stay after more than a few weeks without good reason

        No, I don't think their representative was at all pleased! She was very confident and self assured which made it even more satisfying! (Am I allowed to say that!?!) That was bolstered by the fact that the judge finished by ordering them to pay my expenses for my visit to court!! Oh dear..

        She had approached me outside of the court room whilst we waited and confidently stated their position. She said there was nothing that we could agree outside and that the case just needed to go in front of the judge - which I found quite unnerving. She seemed supremely confident and I wondered what on earth I was in for!

        Once sat down, she opened up quite a hefty file of paperwork which was littered with neon page markers throughout! Must have taken quite some time and expense to prepare so I can't imagine it went down well at all!! That's without the cost of the court fees etc.. No, I think her tail was firmly between her legs by the time we'd finished.. Don't think she knew who she was dealing with!!! Tee hee.

            Thank you. Just before we wrap up, can I just ask what I should expect now please? Is it likely that the file will be passed back to Cabot and they'll then continue to try and collect the debt despite being their legal team being unsuccessful in obtaining a summary judgement against me?

              Cabot failed to get the 'stay' lifted, they'll be a Order in the post, Cabot has to 'abide' by the Order. They can't 'pursue' the debt through the Courts.
