  • Claimant telling me to arrange set aside request with their solicitor

    Hi there

The claimant (Cabot) are telling me that I have to deal with their solicitors to ask for consent to set aside a judgement. I didn’t receive the claim form in time so would like to defend it. I have told them that as the claimant they have to instruct their solicitors. I’ve wasted nearly a week telling them this twice. Just wondered where I explain this to the court? Is this them not consenting? Would it be in my draft order that I write this or in my witness statement? Tbh I’m struggling to understand what I have to write in the draft order as I don’t fully understand it.

    Best wishes

    Contact the solicitors.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read this: https://www.judiciary.uk/wp-content/..._in_Person.pdf

Okay I’ve emailed the solicitors (I thought I had to get consent from the claimant directly). I’ve nearly got my N244 application ready incase they say no.
