first of all thanks for this resourceful forum and your time on helping us!
I’ve got a court claim from UKPC parking my mooped in Leyton Mill, Asda supermarket back in 2018. I remember clearly I’ve genuinely parked on the bicycle spot thinking it was okay as I couldn’t see the motorbike one… for probably 15min!
I’ve requested a Sar and got all the evidence from UKPC on the same day.
I’ve acknowledged the court claim on the website moneyclaim.
I’ve used the template to fill my defence and I’ve sent it last night as a pdf to the ccbcaq email below the paragraph I’ve wrote:
“
3. The Defendant went to Leyton Mill Retail Park, Marshall Road E10 5NH on the 28/05/2018 for shopping at Asda supermarket like many other times. However, on this particular day she did not use the car but her small Vespa moped. From the main parking entrance, the Asda supermarket is slightly on the left side and there is a small roundabout to diverge the traffic going to different areas of the parking lot. The first place that can be seen coming into the roundabout is a vaste paved area with a designated parking spot for bicycles with a bike sign. The Defendant parked there in a proper manner, near a metal post to lock it, considering there were also electric scooters and electric bikes when arrived and the moped did not obstruct anything. No signs for designated parking for motorbikes were clearly visible from there and she genuinely thought it was the right place to park her moped. Also there were no visible UKPC parking signs in the bicycle area to read; those are in the middle of the car parking lot scattered around with very small notes impossible to read. After a very short period of time in the supermarket, the Defendant found the parking notice on the windscreen stating that the vehicle was parked in breach of the Term and conditions signs. The Defendant did try to find the parking inspector and to talk with a supermarket representative but she wasn't able to do so. As shown in the photos collected by the Claimant's inspector the moped wasn't parked in an abusive way and the space between the metal posts looked like a specific spot to lock a small moped like the Defendant's one.”
now, I’m not even sure I’ve got ground to win this battle although I think we should make those company stop harassing people in this way!! This is just madness. (I did received threatening letters from debt collector several times for this too). I’m looking to see how the defence process goes for other motorist but cannot find anything. Also, if I lose now how much more do I have to pay? I’ve got already £312
what’s your advice?
Attached the photos of my Vespa from the Sar which I haven’t attached on the defence as I’ve understood I should do this in the witness form, correct?
