    your defence would mention on such a date a request for CCA was made to date no response also CPR 31.14 would be recorded in defence if sti;; out standing

      If you don't file a Defence, the creditor could get a Judgement against you by Default. Which could lead to a CCJ.

      Send the Defence in on time.

      a) Fill and amend it carefully,
      b) make sure you get Proof of Postage when you post to the court.
      I'm one for sending the other party a copy, although unnecessary.

        Hi echat11 ive just realised something i didnt receive the claim form until the 27th but it is dated the 21st does this mean i have 28 days from the date on the claim form to reply or 28 days from my acknowledgement? do i fill my defence in via the moneyclaim site and also via letter? sorry for all the questions

          You have 14 days from the date on the form, once the Claim has been acknowledged, you get an extra 14 days, which gives you 28 days in total. You also get an extra 5 days because of how the post works.

          The Moneyclaim site only accepts 1000 characters, if your defence is less then 1000, you'll be o.k., if not post it, get Proof of Postage. Send the other side a copy, again get Proof of Postage.

            Right ok so if i acknowledged on the 27th of October does that mean i only get 14 days which would mean i need to submit my defence by tomorrow the 10/11? plus the 5 days on top so at latest my defence needs to be submitted by the 15/11.

            I haven't even thought about what to write for my defence as of yet so really need to sort that ASAP im not sure if it will fall under 1000. if it is over 1000 do i still have to submit anything on moneyclaim and explain this?

                If the date on the claim form is 21st October, 28 days from that date, so the 18th November is the deadline. Then you have 5 days, post etc, but don't leave it until the last minute.

                For your defence read post 17. You only do one or the other. You either submit on line if the system will let you (under 1000 characters), or you send in the post. It's pretty straight forward.

                  echat11 sorry!!! I sound so stupid I was just confused with what dates counted from where? I will get working on my defence this week would it be ok for me to post here for you to have a once over before I send? Thankyou

                          Hey echat11 I hope you are well? So i have submitted my defence online this morning as it was under the number count and hopefully all correct. The only issue was on the claim they have the incorrect address also I'm guessing provided by over dales so i think im going to send a recorded copy with a note in there explaining the correspondence address is incorrect or would i be best trying to call the court to see if this can be updated? Thanks so much for your help

                            You could do both, but make sure you get Proof of Postage when you send it to Overdales.
