  • Name on county court business centre claim form

    Hi, I have received a county court claim form, but the claimant has not used our correct Limited building company name and has also put my name in brackets next to the incorrect company name. I am a director of the company. The claim is small <£500. I would rather just pay this claim, even though the details of the whole are actually incorrect, I think if were to go to court, may be 50/50 chance of defending. The claimant has also informed me they are going to make this claim, and then claim for a much larger and +£5k in the next 28 days. The larger claim I want to defend, but don't want to implicate myself personally by paying the much smaller claim. Any help much appreciated.

    So they are going to claim for the same reason twice, just different amounts? Don't think the courts will be pleased with that.

    So your defence will be that they are claiming from the wrong identity. You, as a director, do not have a contract with this person. If the details are incorrect then you only need to show that the claim details are incorrect

      Any claim needs to be against the person (individual or company) that has the contract with the claimant. Sounds like they've got that wrong and their claim would fail unless they withdraw and issue a fresh claim.

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
