  • Setting aside a CCJ after paying?

    Hi All!

    I was hoping to get some advice on a CCJ that i was made aware of on the 03/08/21.

    I received a notice of enforcement for a CCJ for 200 odd pounds and was told if i did not pay that i would incur more fees and people would be coming to my door.

    I had no idea what the fine was regarding so i contacted Gladstones solicitors who had passed the CCJ to this enforcement agency.

    Gladstone's got back to me and said that they would provide me information which they did on 16/08/21 stating that i had an overdue parking fine which is now a CCJ and i would need to contact the enforcement agency ''Empira''.

    I contacted Empira and told them that i was not aware of this prior to their letter and didn't want this to be on my credit reports in future as it would be detrimental to my future. They advised me to pay it in full, which i did today.

    I told them that I was completely unaware of this CCJ prior to their letter and I didn't want this to impact on my credit report as I am a private renter who will be needing to move home soon.

    Now i am reading online that there is a potential to set aside a CCJ and i was wondering if this can be submitted after i have already paid it as was unaware of this fine?

    Any support and advice anyone could offer would be hugely appreciated as I'm now worried that I messed up and fell pray to their threats that will have an impact on my credit for the next 6 years

    ostell if paid within 28 days it does not show, such a small amount and cost involved £255 to set aside , parking charge then move on? unless circumstances as to parking issue then???? to set aside you would need prospects to not receive a CCJ?

      MIKE770 Sorry, just to clarify the CCJ was ordered over a year ago and they had been sending letters to my old address. It was only when the enforcement agency got my updated address did I find out about it.

          So you might get a set aside because of the incorrect address but would you be able to succeed at defending the claim?

          If all you want is the entry to be removed from the register then the creditor might be willing to agree to an agreed set aside for a fee of £100.

            ostell Thank you so much for your reply!

            Yes I do think I have a good defence, however my main goal is to have a clear credit record without too much hassle! So if this could be set aside with a fee that would be preferable!

            Just to clarify, the fine started with Parking Control Management> Gladstones> Empira. Would it be as simple as emailing PCM? Explaining that I have paid the CCJ, but I wasn't aware of the initial fine and ask them to agree a set aside?

            Again thanks so much for your help, this is the first time I've had something like this and the anxiety is through the roof!

              Whichever way you go there is a fee. Without agreement that is £255 which you may be able to recover.
