    Hi all, first time posting here as I have just noticed a CCJ on my credit file from around 7 years ago but has only just gone on my record (feb 2021)

    I am just in the process of buying my first home and the mortgage company has noticed a CCJ on my record which I was not aware of. I have accounts with equifax and Experian and nothing has ever flagged on there so it came to such a shock that they came across that. I created a checkmyfile.com account to try figure out what it was and then I noticed it was under transunion.

    It states the case reference and which court has filed it so I have contacted them and they have advised me it it Lowell solicitors who have taken this debt on on behalf of talktalk. I then contacted Lowell solicitors and gave above reference and they said it was an address that I resided at maybe 7 years ago. I lived there with a friend for a couple of months and we had talk talk broadband but I’m pretty sure I cancelled the contract and had nothing outstanding. I wasn’t down as living there as it was only a temporary thing.

    I have kept on electoral roll and always kept address up to date but I have never received any correspondence about any outstanding bill and I still wouldn’t know about it now, it’s only because the mortgage company have notified me that Im
    mot actually aware of it.

    Can anyone please advise me on what I need to do to get this take off my credit report? I am willing to pay the bill but I find it so frustrating that they’ve given me a CCJ when I didn’t even know anything about it! And for it to come back up so many years afterwards is just mind boggling.

    Can anyone advise? I’m contemplating paying lendercourt to have the CCJ removed for £600 as I don’t know what to do!

      Hello, I understand that this can be very worrying for you. Usually, a CCJ should "drop off" your record after 6 years. You can apply to get the CCJ set aside yourself by filling out an N224 form which does have a fee of £250. n244-eng.pdf n244-notes-eng.pdf

      You can choose to defend the claim as it has been posted to the wrong address and also it has been over 6 years, why has it came up now. You will have to show proof of the wrong address as well as the time that has passed. The court can decide to set aside the CCJ through a default judgment meaning that it will be removed from your record once the register has been updated.

      You can pay solicitors to fill out the form for you however you will have to incur their costs as well as the costs of setting aside the CCJ.

        I am very curious as to why the CCJ is dated from 7 yrs ago but had only just appeared on your credit file? This does not sound fair or right?
