Lowell court with Deed of Assignment

Hi

I have court on Monday with Lowell.

I have been on BTB and followed all of their guidance have 3 lettered, pre action letters, defence and witness statement etc.

In Lowell's bundle they sent some pages of their 'Purchase agreement' - it doesn't say anything significant, just they purchased the accounts etc. It is very heavily blacked out with several pages missing.

They have the default notice so cannot argue that point.

Any last minute help, I really don't want a CCJ as I've been carefully trying to repair my credit file.

What is BTB?

I don't know what is meant by you having '3 lettered' Lowell but if it is what I think you mean it to be i.e. the 3 letter process then I'm afraid you have been duped because that 3 letter process is a nonsense and the contents of those letters are utter rubbish (as you may well come to realise).

Unfortunately, you are bound by the contents of your defence and witness statement so coming to us last minute is probably going to be a waste of time. If your defence and witness statement is along the same lines as the 3 letter process then you might be on to a loser.

I'm afraid that anything we say now is probably not going to help you.

Out of curiosity, what was your defence?

How did court go on Monday? Please update us.Don't feel awkward if you've been duped, it's happened to many of our members in the past.
As you may now know, assignment is not a strong defence point and can be remedied.
GetOutofDebtFree has long disappeared, but Beat the Bailiffs seem to have adopted it (3 letter system) enthusiastically. We had one of their members here recently claiming that when they lost and tried to discuss this on the FB group, they were banned. I can't be sure if it's true or not but does not sound ideal.
The only methods that Judges have ANY time for (bearing in mind they don't like consumers asserting their rights at the best of times) is statute legislation such as CCA 1974 and Limitation Act, as well as key case law like Carey v HSBC.
