  • Cabot Financial

    Hi all,

I'm hoping you can help me with this.

I received a claim from Mortimer Clarke solicitors on behalf of Cabot Financial for an alleged credit card debt.

I responded to the claim within the timescales allowed and submitted my defence, which they have not responded to within the 28 days allowed. The solocitors sent me a letter last week indicating they have referred my defence to the claimant, but have not formally responded through the court.

My understanding is the claim should be stayed, but is this done automatically or do I need to follow a process to have this done?

The defence was submitted in the first week of February. so they are massively outside the timescales.

Thank you. So I just need to sit and wait? I thought they only had a finite period of time to reply?
