So they are taking you to court for the PCN and also another person for the same incident. They cannot have it both ways.

When you win then if they take someone else to court then they could have problems as this has already been decided

So my partner wants to ring and pay and on the basis they revoke the court claim against me. Essentially pay £60 so I don't have to take the afternoon off work and go through the small court claims experience...

Can they still take me to court after sending a PCN to somebody else?

Can they still lawfully send a PCN now after the driver identified themselves on 27/08/2020 and confirmed their address details on 24/09/2020?

They can take you to court but your defence will be that you cannot be held liable as the driver has been identified.

As this is small claims then normally no, apart from £96, but if you can show that they have been unreasonable then you may be able to claim more.
