  • N244 Hearing

    I think I posted this in the wrong forum section yesterday because I have received no replies.

    The Claimant won a court order for me to make monthly payments to them. I have recently applied to the court to reduce my payments due to lack of income.
    The claimant does not agree that the court has allowed me to reduce my payments. The claimant has submitted an N244 application and there will be a hearing.
    The Claimant is instructed to send a bundle of documents 3 days before the hearing. My questions are:-

    1. Do I have to respond before the hearing with my objections
    2. If the answer to my first question is “yes” then do I have to send my objections to both the court and the claimant?
    3. Do I put my objections in the form of a witness statement?

    Have you provided proof of your reduced income & also expenditure you are responsible for? What are there objections? How much was Judgment for and how much are you proposing to pay & is this substantially different to what you were paying? Has the Judgment been subject to any enforcement?

          I disagree, the points raised by ploddertom are extremely relevant and without you answering them, we cannot answer your questions. Well we can but it wouldnt be helpful to you if we did.
