  • Simple Procedure Scotland/Lowell/Shoosmiths

    Received a claim? Yes - simple procedure forms:
    Issue Date: March 2020
    Have you Acknowledged the Claim?: indicated defend.
    Total Amount Claimed : £1000
    Claimant’s Name: Lowell Portfolio
    Solicitors Firm: Shoosmiths
    Original Creditor: Shop Direct
    Original Debt: Online Account.
    Particulars of Claim: Claim is for money owed/debt
    Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?): No contact with anyone since Nov 2016
    List any letters you have sent (eg: CCA/ CPR ): Sent CCA letter to Lowell, no reply as of yet.
    Any Other Information or Background Details:

    Letter received from Lowell indicating action will be taken regarding such, so CCA request sent mid August(when letter received. no reply as of yet.
    Letter from Shoosmiths received 2 days later saying action will be starting, as client has stated that it may pause due to Covid, but that they want it to advance now.
    Large envelope delivered to another street, recorded delivery and posted through my door by other tenant, not signed for by either them or myself.
    Sent from sheriffs court local to myself, action registered in March, but handwritten over bad stamp.
    Sent off pack indicating defend.
    Sent another CCA request towards end of August to Lowell, no reply.
    Sent copy of CCA letter to Shoosmiths, no reply.
    Letter received from Sheriff court saying that we in the first instance must attempt, between the two parties, try to reach an agreement, and a date given of end of October for appearance in sheriffs quarters for a meeting(thats what I take from the letter).

    * - Amount of debt on Lowells letter differs from Shoosmiths, and also differs from Simple Procedure forms.

    Any ideas, on what to do next?

    All a bit flummoxed with what to do !

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
