  • Noice of proposed Allocation to small claims track

    Hello I have had this today, long story short Hoist Finace claiming I owe a debt to a barclaycard, I did a CPR31.14 request to them and Cohens solicitors , I received a letter from Cohens about an extension to this. I have heard nothing until the allocation came today. I don't know what happens now, how do I respond to the allocation forms. I have until the 14th April to do this. Please help

    On the notice of allocation there will instructions called 'directions' that indicate what you need to do next, as well as the date and time of the hearing. The directions will include tasks such as disclosing evidence to the other party and you may be required to write a witness statement. Does it mention completing a witness statement anywhere on the allocation?
    If you sent a CPR31.14 request to the other party, have documents already been disclosed?

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
