  • Challenging witness statement

    Hello,
    I have received the claimants witness statements in preparation for the hearing, however there are a number of inaccuracies and untruths within the statements.
    I have evidence to prove some of the untruths such as text messages etc.
    My question is how do I effectively challenge these statements and ensure the judge has visibility of my additional evidence. Can I submit a supplemental witness statement or can I take copies into the hearing with me and wait to see what happens in cross examination? I don’t want to turn up with more evidence and annoy the judge but I believe I need to challenge the lies within their statements as it can impact the judgement.

    If you believe the witness statement is incorrect, it is very important that you challenge it. Providing a false witness statement is a serious offence and if you can successfully contest it in court, it will help your case. Judges appreciate bundles and court documents provided in a logical order before the hearing begins. Therefore, I would advise preparing a supplementary witness statement before you attend court that outlines the discrepancies within the claimant's witness statement. To make your statement reader-friendly and to make your arguments clear, label the screenshots of the text messages and other messages so you can refer back to them. Best of luck with your hearing.
