  • BW Legal Talk Talk claim

    Hi all really needing some guidance. I have just received a county court claim form. The claiment is JC International Acquisition working on behalf of BW Legal for an old debt from Talk Talk. The sum is for £124.24 and the agreement was assigned to the claimant on 3/4/2014. Does this make the debt status barred? Also I need to know how to proceed with the claim form. Any help is hugely appreciated.*

    What date did the debt with TalkTalk come due?* Statute barred after 6 years.

      Hi Ostell. All it states on the particulars in regards to dates is " The rights, benefits and title the agreement have been assigned to the claimant on 3/4/2014. To me that seems that it's statute barred. Maybe I'm mistaken.

        Just realised it's not statute barred but not bloody far off. So is there any other way of defending this debt or is it just easier to pay it?*

          Can I send a CPR request through to them. Because it's telecoms I can't request a copy of credit agreement if I'm thinking correctly. Please any help is really appreciated*

            So a SAR to Talk Talk to get all the info they have on hold.* The statute barred period is from when the debt was owed to Talk Talk not the purchaser of the debt.* When did the debt become payable to TalkTalk?

              I'm guessing the debt would have been before the date they are stating on the particulars. Because the debt was purchased by bw legal do I send the SAR request to them? What's confusing me is that the claimant is listed as JC International Acquisition but address for sending documents and payments is listed as BW Legal.

                SAR to the claimant and Talktalk.* *Their web sites should give the address of a data protection officer.* Hopefully you will find out when the account was defaulted.

                Also a letter to BWL demanding copies of all documents that they intend to use in court in order to reduce the differences* between you, as expected by the court.* You expect this by return and in any case within 7 days.

                Have you acknowledged the claim using the details and password on the form?* Nothing in the defence.* This gives you 33 days from the date of issue to get your defence to the court
