    Hello. New to this forum so please be patient. Last year my ex husband helped me to repair my car. He works for a garage. He said that he did this as wanted his boys to be safe when in car.
    The relationship deteriorated dramatically and he had been extremely unpleasant since. I have now received a CCJ for the money he says he spent on fixing the car. At no time did he say this was a loan. I haven’t signed anything. I have no proof that
    he has actually spent money on parts etc ie no invoices. Unfortunately I did ignore the Claim letter as have been suffering with severe anxiety, but no invoices were included with this letter.
    Where do I stand legally. I wasn’t told it was a loan in the first place. I think he is just now being spiteful.

    You have to pay it or pay about £250 to get the CCJ set aside which you will probably not be able to recover & the debt may still stand. The courts do not like being ignored & the CCJ is a result of you ignoring the instructions of the court.

      I know was stupid to ignore the claim and beat myself up every day. Unfortunately I am unable to pay the sum requested - just under a £1,000. I am going to submit my earnings and expenditure etc and make an offer of a monthly payment. My question tho is I have no proof that he did indeed spend this amount of money on the car. He could have just made the sum up. Can I not ask for proof - invoices etc.
      Thank you. I find it quite incredible that he has gone this far when I am pretty much sole carer for our two boys. He rarely sees them.

        Without applying for a set aside, which is unlikely to be granted as you merely ignored the court, then you have no power now to request that information. It should have been done as part of the court proceedings.

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
