    Hi Guys

    I’ve also recently been on the firing line of Lowell’s latest County Court spree and I thought I’d share my experiences as I notice there are a lot of people receiving claim forms from Lowell!

    Early last year a load of defaults appear from Lowell on my credit reports.

    August last year out of the blue I received a Lowell claim form for £3,000 for a collection of debts from 5/6 years ago and one even going to 2008!

    No letter before action so this was my planned route to having the claim struck out.

    I defended the claim and we both sent our DQs - they refused small claims mediation so a date is set for the hearing as November.

    About 6 weeks after the DQ deadline I got a notice of discontinuance out of the blue as Lowell pulled out. The credit agencies then corrected and removed the Lowell entries from my report a month later.

    I personally think Lowell’s strategy is to hope you don’t respond to make it easier to send the proper bailiffs round or get an attachment of earnings. If you defend the claim they probably know they’ve got nothing to back it up and just pull out.

    not sure what other people’s experiences are but I’d say not to panic - follow the procedure and see what happens

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
