  • Small Claims Court - cost of personal time

    Hi,
    My first post on Legal Beagles - I have taken a Company to the Small Claims Court and they settled in part. They have responded to advise 'that monies now being claimed are purely for 'personal time' and as such aren't able to be claimed for on this track anyway' (Product cost, postage and claim costs paid)

    Just after some advice to determine if I am unable to claim back my time dealing with the Company trying to get resolution before the claim?

      Can the OP claim more than the fixed costs on commencement of the claim? For a claim amount of between £25 and £500 that is the princely sum of £50. Is that not meant to cover the time spent leading up to the claim as well as during it?

        Small claims does not allow claiming for costs, expect in very limited amounts which you have found. If it can be shown that the opponent behaved unreasonably, a high bar, then yes time etc can be claimed.

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
