    thought people on here would be interested. in June this year got a warrant of control from bailiff at locsl court. found out in 2012 a ccj was taken out on me from arrow global at my old address. did not know about it, did not recognize it. at this time in june my daughter was seriously unwell. I applied for it to be put asiside, but was refused. later arrow sent me an income and expenditure form. filled it but made it plain did not recognize debt. i put in household expenditure and income. then in november had bailiffs turning up whilst at the hospital with daughter. we put in a form to set it aside online. a court hearing was set for todays date. had paperwork from arrow, this time it had a deed of assignement in as well bizarrely signed by A4. yet the solicitor admitteed it would take time to get original documentation from original lender in support of the claimant. went today to court, the solcitor for Arrow said I had admitted to the debt, I said I never had. She also said for income and expenditure form I should only put my income in not the households. we went in , I pointed out to the judge that all along I had asked for true copy of the agreement of the credit card and how I had accrued the debt. the judge asked the solicitor for proof of the credit card agreement and debt, which was not forthcoming. The judge then adjourned the hearing for three weeks , telling solicitor Arrow have three works to come up with the proof of the credit card and subsequent debt. If it had been the judge in June , I would not have had this chance, he said I owed it and would not set it aside . will see what happens, if Arrow do come up with the proof. Also interesting note, I have been told today the debt ,ccj applies to the one person, so it is only my income and expenditure within the househild, not the households.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
