  • Court Claim - IDR Fiance UK II Limited / Barclays - 19-12-2017

    Received a claim? Yes
    Issue Date: 19-12-2017
    Amount approx: 3300
Claimant: IDR Fiance UK II Limited
    Solicitor: Kearns Solicitors
    Original Credit: Barclays

    Particulars of Claim:
The claimant claims the whole of the outstanding balance due and payable under an agreement referenced: xxxx and opened effective from 11/09/2008.

The agreement is regulated by the Consumer Credit Act 1974, was signed by the defendant and from which credit was extended to the defendant.

The defendant failed to make payment as required and by 26/12/2013 the defendant owed Barclaycard plc the sum of xxxxx (this figure is not the amount being claimed & is hugely infalted!!)

By an agreement in writing the benefit of the debt has been legally assigned to the claimant effective 18/12/2013 and made regular upon the claimant serving a notice of assignment upon the defendant shortly thereafter.

    And the claimant claims:
1: xxxxxx (this figure is not the amount being claimed & is hugely infalted!!)
2: Interested persuant to section 69 county court act (1984) at a rate of 8% per annum from 18/12/2013 to 18/12/2017 of xxxx (this figure is not the amount being claimed & is hugely infalted!!) and thereafter at a daily rate of 50 to date of judgement or sooner payment.

    Date 18/12/2017

    Stat Barred? No

    Have sent: Acknowledged the Claim

    Other Info:
Will be sending CCA & CPR requested off today or tomorrow latest.

Weird that the figures in the particulars of the claim bear no resemblance to the amount being claimed in the totals box?

    Hi,

Can anyone offer any further advice on what I should be doing?
Or is it a case of sitting and waiting until the CCA etc comes back?

    Thanks

The OP says they’ve completed the AOS, sent a s77-79 Request and a CPR 31.14 Request.

The Defence deadline is 33 days from the claim Issue Date.

I would add to that send a Subject Access Request to Barclaycard.

Oh, and IDR Finance UK II Ltd may have licensing issues.
