    Particulars of Claim:
    the claim is for the sum of £xxx.xx
    due by the defendant under an agreement
    regulated by the sonsumer credit act 1974
    for a xxxxxxxxxx account reference of xxxxxxxxxx,
    The defendant failed to maintain contractual payments
    required by the agreement and a default notice was served
    under s.87(1) of the consumer credit act 1974 which has not
    been copiled with.
    The debt was legally assigned to the claimant 0n xx/xxxx/xxxx,
    notice of which has been given to the defendant.
    The claim includes statutory interest under s.69 of the
    county courts act 1984 at a rate of 8% per annum from the
    date of assignment to the date of issue of these proceedings
    in the sum of £xx.xx.

    Remember in the CPR 31.14 request you can only ask for documents mentioned in the particulars of claim

    I am guessing this was opened fairly recently

      hi ,
      thanks for pointing that out ,at the moment we dont no to much about the claim. think we are like alot people and think it will all go away but this we are defending it.
      they say we was sent a defaultnotice but to honest carnt remember ever getting one. thats in particulars of the the claim, as is the date of assignment and of cause the amount they say we owe.
      not much to go on, so is that all i can there ask for with solictor.

        oh forgot to say got claim on 9/11/17
        new to all this but when i reply to some body am i bet putting username to stop any confusion. sorry if its a daft qestion.

          hi , i need a question answering please,
          on the cpr 31.14 template letter its says creditors details do i put the name of creditor or the name of the solictor on letter or may be both.. i no it gets posted to the solictor but i dont want it getting sent back to me.

            Hi
            If the claim form gives a name of the solicitors for service of documents which they usually do that is where you send the cpr request to. You send the cca to the creditor along with the fee and a copy with the cpr but make sure you reference it is a copy.

            Both letters - keep copies and send by signed for delivery.

            No need to sign your posts as your name is on the left hand side

            Just take a breath and calm down.

            From the date printed on the claim form you have 19 days to acknowledge and 33 days to enter your defence.

            Try to do it online via MCOL if you can

                hi, hope somebody can help
                need help with the cpr letter i am doing.
                i have posted the particulars of the claim now.
                If i word the following things below i need to ask will that be ok
                not to sure about the formal demand because i dont what it
                is and its not listed in the particulars of claim
                ]1 The agreement
                2. TheDefault Notice
                3. Deed of Assignment
                4.Formal Demand
                also in the actual letter do i need to write the claimant details or the claimants solicto

                  I do not think the name you put in the cpr request will make a lot of difference , I just left that bit out and put the name of the claimant v me and the claim number. You must of course send it to the solicitors ( if they are in the box that says service of documents)

                  Technically there is no mention in the POC of the formal demand
                  aklso I would ask for the notice of assignment and the deed of assignment

                        did you get a letter Before Action/Claim? If so what date? And did it look like the one described in here https://debtcamel.co.uk/letter-before-claim-ccj/ which had lots of attachments?

                          There is a nominal timescale but to be honest why chase them to produce evidence that could sink you. It is, in many ways better if they do not produce anything

                            but i can not remember seeing one.

                            think i gave them 14 days to respond
                            but wasnt going to follow that letter up.

                              It is a good idea ( I think) to specify a timeframe in which they should reply but do not chase them as it may just remind them to get on with the job

                              With regard to you answer to DC- I know where you are coming from, there was a time I hid everything in the bin but then it was suggested I should keep everything. I now keep as well as scan and upload to the cloud all the documents I receive - makes life so much easier , especially , if I suddenly start to worry about a particular debt I can just get out the papers and remind myself they haven't got a leg to stand on
