  • Can someone advise on costs implications for losing an application?

    I was previously advised that generally speaking, on the small claims track, if an application is made by the other party, it is opposed, and then successful, the losing party has to pay the winners costs, and vice versa?

    In the small claims track the unsuccessful respondent is normally ordered to pay the court fee. Both parties bear their own legal costs associated with the application.

      https://www.justice.gov.uk/courts/pr...s/part27#27.14 contains the rules on costs in the Small Claims Track. I did not use any AI tool to find this.
