  • Vehicle seizure by enforcement agent - court dismissed the case

Vehicle was seized due to an unpaid PCN debt issued by TFL. Enforcement agent clamped and seized a vehicle owned by a third party. I paid to get the vehicle back. The vehicle was registered with DVLA under a dormant company and the warrant of control had the name of the company. My argument is that the vehicle was not a company asset and that it was personally bought with my own funds, including paying for tax, insurance, MOT etc. I took it to court for unlawful seizure and they dismissed the case due to it being brought to the wrong route. Which route should I have taken and is it appropriate to complete the N164 form to appeal. The case was heard on the 17th March 2026. I should have brought the claim via Part 85 had I had known at the time. It could take upto 20 weeks from the 17th March to receive reason or/and transcript as I will need this in order to appeal I lelieve. Are there any other alternatives in recovering the amount I paid to recover the vehicle and also the court fees and possibly damages that would provide an successful outcome. I have received the sealed order which only states 1. Case dismissed.2.No order to costs.
