  • Financial Investigation SLAB Section 35

    Hello,

After unsuccessful attempts at contacting solicitors I am here to get any advice. Legal aid was granted now after futher checks they have flagged up 4 things and now given me a deadline to respond. They may refer the matter to prosecution service depending on my response.

I need to think 1 step ahead worst case scenario incase they forward my documents to the CPS then i imagien i would have a bigger case because I know from past experience they incriminate your story and your documents to work against you.

The claims are declaring different information than what was in the original application at the time, bank accounts one which is joint. If i send them my bank statements it may open up a can of worms especially with CPS questioning every transaction and requesting last 6 months plus.

They have accepted my request for an extension of 7 days only. My questions are 1. Should I review this will a solicitor who specialises in this field (another solicitor said its not appropriate for another solicitor or firm to make comments or give advice on an application done by someone else its them you need to raise this with) they are unavailable till way after my deadline. There admin worker responded after telling them all the solicitor are busy at court and unable to make calls unless a telephone appointment her diary is full till mid june! She told me what was it about I said a financial investigation with the legal aid board looking for a response and possible section 35 implications providing false/fraudulent misleading information to gain legal aid she replied go ahead thats something you can respond to yourself!

So, its most likley i will go it alone and want others opinions on what documents, statements. i should submit to defend myself so it doesn't esculate. I mentioned to them i will fully coperate into the inquiry with full response and disclosure of information.

I think that SLAB section 35 may refer to Section 35 of the Legal Aid (Scotland) Act 1986.

EXC - can this be moved to the 'Scotland' forum?
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.
