    Hi Guys

    I'm back again after a short break ( you helped me win a court claim in 2025)! I now have another court claim dating back to a PCN in 2020. I would appreciate what you think is the best way to word my defense.

    The vehicle is my sons Motability wheelchair vehicle and I am the registered keeper. In Sept 2020 we were in Leicester meeting up with my daughter who was at Uni there. We took a wrong right turn that took us into the car park. As I recall there were no clear signs visible to approaching drivers warning it was an entrance to a carpark at the back of the buildings. It looked like a normal street until you had turned into it. By this time you had no choice but to enter the car park to turn around.

    We remained in the car park for approx 5 minutes while we searched google maps to find our destination and get back on route. We didn't park up, exit the vehicle or even turn off the engine. We found our bearings and moved on.

    Shortly after I received a PCN saying we had breached parking terms and had stayed 6 minutes. They had pursued me as the driver (I wasn't It was one of my son's Carer's) so I appealed in writing like they asked and sent it to the address given on the back of the PCN. As per normal with these companies it wasn't acknowledged and they sent a couple more letters and then I heard nothing more until recently. I am quite shocked that they would waste court time for a 5/6 minute turnaround that was clearly not parking! I am going to defend this in full and would appreciate advice on the best way to go forward with this.

    Remaining in the car and not switching off the engine or the Morability aspect will not count as any form of defence, so it’s best to focus your energies on signage and clarity. This could be hard after so many years, but Google Streetview may still have some images of the street scene at the time and possibly views into the car park.

      So first of all acknowledge the claim, but do not enter a defence yet.

      Then send a Subject Access Request (https://legalbeagles.info/library/gu...ccess-request/) to ParkingEye
      and a CPR 31.14 request (https://legalbeagles.info/library/gu...-of-documents/) to DCBL

      ​​​​​​​When you receive a response, or around 1st April. give us a nudge so we can help you prepare a defence.

              SAR to PE ... all information
              CPR31.14 to DCBL ..... documents mentioned in statement of case, especially 1) PCN & 2) all signage

                    Guys im trying to send my CPR31,14 to DCBL and am confused by the template i downloaded from your site, please help.

                    It says delete all red text but there is this park at the end in red that says "For your information and records I enclose a copy of the formal request for a copy of the credit agreement relating to this claim, pursuant to the Consumer Credit Act 1974, which has been posted to your client with the statutory fee of £1 today, xx/xx/xxxx."

                    Im assuming I need to add this text?

                    Also what copy of formal request for a copy of the credit agreement do i send? does this mean I send them a copy of the SAR I sent to Parking eye? I am conscious of time running out but am worried about putting the wrong thing. Do I send copy of my SAR request, is this the copy of credit agreement or is this for loan claims?

                      That part does not apply to your situation!
                      Perhaps I should have explained that the guide was drafted for debt claims to do with a credit agreement ... my apologies.
                      Your request is for all documents they intend to rely upon, especially but not exclusively, the PCN and Signage

                          Hi sent off m requests and got automated receipts of delivery from PE and DCBL. Also got a response from Parking eye and wondered if this info was useful for future reference? I sent my SAR to DPO@parkingeye.co.uk and cc'd in info@parkingeye.co.uk. My response came from Privacy@parkingeye.co.uk - (Display name SMB_PE_Privacy) just thought the more email addresses we have the better!
