    Has the court told you the claim has been allocated to the small claims track ?

    You could remind them of the overriding objective as set out in CPR1 (https://www.justice.gov.uk/courts/pr...l/rules/part01) but it will be a waste of time!

      The last transaction on the claim status is:
      DQ filed by claimant on 27/03/2026

      I will check the post but based on the above, I don't think the claim has been allocated to the small claims track

        Go back to them and tell them that you will bring the courts attention to their incorrect & misleading assertion that the claim has been allocated to the SCT.
        You are also minded to report the matter to the SRA (Solicitors regulation Authority ) as they seem to be intentionally misleading a Lay person

          I've just found a letter dated 27th March, of notice of proposed allocation to the small claims track!

          Unfortunately, it seems they I have missed the deadline of 13th April to complete the small claims directions questionnaire.

          I'm really sorry, I don't know how I missed this letter!

            So complete the Directions questionnaire NOW and eMail it to court with apologies & a request to submit it late.
            You should include a reason for the delay
            You really want the hearing at your local court so just hope the judge is in a good mood
            For not completing the DQ you could be sanctioned by striking out of your defence.

              Hi DES,

              Sorry for the lack of update.

              My directions questionnaire got accepted by the court, phew!

              Tomorrow I have a telephone mediation appointment. Can you offer any advice in what I should say during this 1 hour long meeting with the mediator? I do not want to back down at all, or accept liability.

                You will not speak directly with the claimant .... the mediator shuffles from one party to the other

                The mediator will be trying to negotiate a compromise settlement between you, (s)he is not interested in the legal aspect.
                All you need to do is suggest that as a commercial decision to avoid the unrecoverable costs that you will incur in your successful defence you will be willing to pay a nominal amount e.g. £20.
                Set your own limit and see how it goes.
