  • bought 5k valueble item , but was lost in post , who is resposable.

    Good day,

Three months ago, I won a gold item at a London auction for approximately £5,000. According to the agreement with the auction house, the item was to be shipped to Switzerland.

When the package reached Swiss Post, its tracking updates stopped. After two months of communicating with Swiss Post (by email, in person, and by reporting the matter to the local police), they confirmed that the item was lost without trace.

The auction house informed me by email that they needed to wait three months for Royal Mail to complete their investigation. However, after two months, they stopped responding to my emails.

A friend of mine, who recently won a small court case, advised me that it would be a good idea to determine who is responsible for the loss.

    Regards,
    Alex

    Hi SWLAPTOPS

    Welcome to LB

The Auction House, you should have to go looking for the item.
They stated they would deliver it.

How did you pay for it?

      Hello,
      I paid by bank transfer.
I called bank already , ironically my bank and auction house bank account banking the same bank.
But bank replayed in case of legitimate transaction nothing they could do.

You should of paid for it via Credit Card.

Does the Auction House have any Dispute Resolution Schemes?

Are they members of any Associations, Trade Bodies etc?

(it will normally say on their website)

For valuable items over £250 posted abroad, Royal Mail advises senders to consider specialised third party parcel insurance or alternative couriers.

The auction house should have taken out parcel insurance to cover £5k or used an alternative courier with appropriate insurance cover.

If the auction house used RM but failed to take out extra insurance they may be guilty of negligence, owing a duty of care to the successful bidder.

I'm not found any information about these on their website.

my bank called me today and said auction house agreed to refund. 10 minutes later it was refunded. strangely looks like it comes from bank not from auction house.
