  • Mortimer - Lift of stay/summary threat

    Hey all

    After some help.

    Today ive recieved a letter from Mortimer Clark threatening to apply for a lift of stay and a summary judgement.

    The orginal case was sent to the court by mortimer in Spet 2024 and i defended the case in Sept 2024.

    They ignored the defence.

    Ive sent a CPR 31.14 to them today.. but i really need to make sure this does end up as CCJ as im applying for a mortgage in Jan.

    Any help would be very welcome

      Welcome to LB

      If they attempt to 'lift the stay', you have the opportunity to defend the lifting of the stay.
      They'll need to provide the Court with a good reason why they have waited so long to
      pursue the claim - 15 months. So you can use that as a defence to the 'lifting of the stay'
      and summary judgement. The Creditor hasn't given you a reason why they've waited so
      long. The only way you end up with a summary judgement, is if you were to ignore a
      Court Judgement.
