Court claim received from Solaris Law Ltd dated 10th November

    Thank you Echat, your help and words are greatly appreciated.

    It all started back in 2021. I purchased a house, friends in construction inductry said will help out with renovation, so we started full renovation with a loft conversion. I took few loans and used few credit cards, was making monthly payments without a miss however credit scoring kept dropping due to amount of credit I had taken. Things went worse start of 2024 when I have tried opening free balance credit card and was denied in few places. From that the credit score completely dropped but I kept going.

    Unfortunately there were few private life issues which caused me to stay away from work for 5-6 weeks. After coming back to work I could not do as much overtime as previously and struggled further with debts spiralling out of control. I have tried suspending payments from few loands and credit cards only to be hit by large amount of money requested 3-4 month later.

    I got to that stage where unfortunately one after the other accounts started being defaulted and I just could not really care anymore at that time.

    I thought I still have the mortgage and it got renewed with a great % and I was hoping to take a full break from a credit trap for a year before getting into some sort of agreements to start repaying defaulted accounts. To be honest I did not expect to be hit with a court summons without having prior notification of the likes like letter before claim or something like that.

    I am just hoping that this case can now get to sort of pause and gives an option to negotiate some sort of payments to avoid court. I am actually afraid that if court makes unreasonable plan that can throw me back into the deep end.....Also, can bailiffs get involved if court payments are followed?

      Stay calm, you are in control.

      You've filed your Defence (the Claim provides limited details), so getting information from them is 'spot on', the Creditor should respond to your Defence, if they don't the case gets 'stayed', you should get a letter from the Court stating this.

      The Claimant should start sending through the requested documentation. You will have Mediation at some point (it's independent from the Courts), so both parties can settle the matter.

      A Court will only ever ask you to pay what you can afford. You can fill in an Income and Expenditure form (with a covering letter), if your left with £1 each month to pay the debts, so be it.

      You can send the Creditor offer letters anytime, but they must have 'Without Prejudice' written on the letter, so the letters can't be used against you by the Creditor.

      The only time bailiffs get involved, is if you ignore a Judgement from the Court. That won't happen, communication is the key, keep on top of things.

          I wish you all the best with Solaris. We had a case in July this year and they certainly try to pull a few tricks right up to the last minute. The first court hearing had to be adjourned as they finally produced a copy of the Assignment document but only did so a day before court! When we eventually got to the next hearing date it appeared that there was a problem with the assignment document where eventhe CEO - Karen Bulgarelli got involved and sent in statements to try to support their failing attempts. In the end the judge saw through their lies and we won!! For a £4k debt that wasnt even owed they spent £10kon legal fees! My advice - push hard for the Assignment document as that is where you may find errors that work in your favour.

            Thank you all. Received quite some paperwork from both RBS and Solaris - I understand I need to look for assignment papers and default notices. Any other important ones to look for too!

                  Ok, so going through both RBS and Solaris Law packs that I have received. These were letters from Solaris Law:

                  The following letter is from RBS pack that was sent as part of freedom information. This was Solaris Law letter sent in September and requested sum gone up form £15k to £20k as they then included 3 accounts. Previous correspondence was 2 accounts claiming £15k and there was a letter in May for the 3rd account (£5k) separately.

                    Looking through the pack, I only found one letter from RBS which is issued June 2025 stating that they passed the largest account to Solaris Law

                    RBS pack also included letters from both Solaris and Equivo that Solaris LAw takes one of accounts from Equivo as of 25th April 2025.

                    However I cannot find any details how Solaris Law became in charge of 3rd account.

                    Also I have no details confirming RBS put in charge Equivo for second account that eventually got passed onto Solaris LAw.

                    Hope all of that makes sense.

                    Should I request proof from Solaris LAw that 2nd account was passed from RBS to Equivo and eventually found it's way to Solaris Law?

                    Also should I request proof from Solaris Law that they were appointed by RBS to deal with the 3rd account too?

                    Or there is enough of evidence to suggest that they are indeed appointed by RBS to deal with the debt and I should make some sort of arrangements now?

                        The only one letter that seems to look like a letter of assignment is the RBS letter issued June 2025 for one of the accounts.

                          The one letter that I have was actually form one of the letters that I have found myself and not the information that they have provided.

                          What should my next step be?

                          Should I send an email or a recorded letter to Solaris to request a copy of a Letter of assignment for an each individual account that they took me to court for?

                            You sent them a CPR request? correct?

                            They've not provided the requested documents, it's not for you to chase them.

                            So 'no'.

                              Unless I've missed something the debts haven't been assigned have they? It reads to me that RBS were the original creditor and are still the creditor, they haven't sold ("assigned") the debt and Solaris Law aren't the debt owner, just acting for RBS.

                              If that's the case there won't be any Letters of Assignment.

                                If this is the case, should there not be a letter from Rbs stating Solariw Law is now dealing with it and not any other party?
