  • County court - Recovery of costs

    Good Morning

    I am an LIP (defendant) and currently involved in County Court proceedings where the claimant has served a Notice of Discontinuance (Form N279).

    I would like to understand the correct procedure from a defendant’s perspective for recovery of costs .
    No out of court settlement has occured. I am unclear on the next steps

    a) Do I need to wait for the court to acknowledge the N279
    b) Do I need to prepare a schedule of costs (in a specific format?) and send to claimant first for agreement or disagreement.
    c) If claimant doesn't agree, is there a form I need to fill and submit to court for my costs
    d) Anything else I am missing?

    Any guidance would be appreciated

    a) No.

    b) This would be wise - send it to the claimant with an invitation to agree costs.

    c) Thankfully, assessment of costs is not an area I know much about. CPR Part 47 contains the procedure for detailed assessment.
