  • Expert Witnesses

I have been asked by the Court to find 3 Expert Witnesses to be agreed with the Defendant and if they disagree then they must supply 3 names. Every company on the Expert Witness Registry that I have contacted has replied that they are unable to help (heavy workload, nearing retirement etc). In order to be absolutely sure of my situation, before I considered taking drastic action, I did find an independent investigator who wrote an Expert Witness report which led to me making the decision to take this to the small claims court but the Court has said a new expert witness must be appointed; one that Claimant and Defendant agree on. Prior to this I had contacted a company to investigate but their report was not detailed and with no conclusion and it was this report that Defendant agreed with it as it suited their narrative; they rejected the conclusion of the second report which was a forensic report. I also found out (at a later date) that the company who wrote the first report is used by the industry that the defendant works in. If we cannot find an Independent Witness that is agreed with by the Defendant, I am anxious that we will have to accept one of their choices as I have read that the Judge will decide which Expert will be chosen if neither the Claimant or Defendant can agree. The Defendant, I fear, will choose an 'independent' candidate from their industry who will be biased in their favour. I am continuing researching. If the Judge decides to go with a choice made by the Defendant, do I have any say in their choice or in the quality of their report should they not match the level of detail and the findings of the investigation that I commissioned that led me to taking this case to Court in the first place. I have started to contact Expert Witnesses from much further afield who are I fear are unlikely to travel the long distance to carry out the investigation and I feel caught between a rock and a hard place and would like some reassurance or insight into my options to keeping my voice heard over the untruthful and deceptive narrative of the Defendant.

Hello, thank you for replying to my post. This is where I found contact details for the experts who are unfortunately busy, also the national industry-dedicated register. I will keep plugging away but thank you.

The AA do inspections, ask the AA if they can do that, but you need an Expert Witness (they do have them), providing you can get the other side to agree to the AA as an Expert Witness.

Is there a professional body or trade association for the particular area of expertise that you could contact seeking a referral?
