  • Personal Injury Claim; Pre-litigation: withholding evidence

    Dear Sir/ madam,

    I am after advice. I raised a personal injury claim in March 2023 for injuries sustained/ aggravated from September 2022 to February 2023.

    The defence has fully denied my claim and are fully disputing it. Evidence has ever been destroyed or falsified. .The deadline is fast approaching.


    My question is:

    Can the defence withhold evidence prelitigation? or am I entitled to see all evidence which they intend to use.?

    I forgot to say, the insurance company said they will only answer legal terminology!

    You need to issue your claim at court. Have you instructed solicitors?

      Good morning Atticus,

      Unffortunatel, I initially went through my Union, who appointed me the Solicitors they use. I went from having a case, to not having a case. Over two years waisted and the clock has been run down.

      the sollicitors I am approaching wont take the case. Reason given, a solicitors has already looked at the case and there is not much time left to investigate.

      The equipment I injured myself using was destroyed immediately after my injuries. Documents have been falsified and a false witness statment has been supplied. I can prove all this.

      According to the Unions solicitors, he spoke to health and safety who deny any wrong doing.
