  • Court claim when I am not home

    Hi all,

    Do you know if there is solution for me if I received a court claim while I am on holiday? I am away for about 3 weeks. What if claim delivered to me on first day? I usually be given 14 days to respond. In this case if I am back after 3 weeks and find this claim, can I apply to court for some workaround?

    You are obviously expecting something. I can think of three options.

    1. Contact the claimant('s solicitor), explain your dates and ask them to agree that if a Claim Form is served while you are away from home they will allow you until [7 days after you return] to acknowledge service and until [21 days after you return] to file and serve your Defence.

    2. Nominate solicitors to accept service for you.

    3. Cross fingers and hope for the best.

      You need to Acknowledge Service of the claim within 14 days.

      The other party would ask for a 'Default Judgement' as you haven't 'AoS' to the Claim within 14 days.

      This is extreme, but will allow you to keep on top of any potential claim.

      The Royal Mail allows you to redirect mail for 3 / 9/ 12 months.
      Change back after 3 months.

      Get it redirected to someone you trust i.e. relative etc.

      They can open the letter from the Court, pass you the details over the phone, you can Acknowledge of Service online.

      So you can deal with it, i.e. request information, file you Defence once you get the requested information etc.
