  • Moriaty law and ccj

This isn't very easy but I'll try to condense it. I'm sick with worry, and I am hoping someone can advise: the original 'debt' was with Scottish Power, I had been on a PAYG meter and paying off debt weekly, then when I left, they said I owed money from an old meter. Ended up at a DCA,, I disputed the debt with them but they did not answer my queries and forwarded the debt to Morality Kaw. Moriaty Law kept sending email and texts, I asked for postal letters only as I did not want to give personal details to sign into their portal. I then found out I had a CCJ. They have now threatened doorstep visits.. I have written to MOriaty Law saying that their refusal to send postal letters resulted in a CCj , Where do go from here? can I pursue a complaint with Moriaty Law< The ccj is over 28 days old. Any advise would be great

    Try not to worry.

    Did you receive Court papers?

Send Scottish Power a Subject Access Request, they have 30 days to provide all the details
on the account, make sure you get Proof of Postage.

Make a formal complaint against Moriaty Law, failure to communicate via your preferred method,
follow the complaints procedure on their website.

'they said I owed money from an old meter' - If it is their fault and you did everything you should
have then 'back billing rules' may apply, so you might not owe the money.

    Regarding a visit from a DCA -

You can send them the following:

    Dear Sir / madam,

    Account No:

Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date. Should it be your intention to arrange a doorstep visit, please be advised that under FCA rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    Yours faithfully

Update when you have more information.
