    Hi,

    I'm looking for some advice, I've had a local company supply double glasing to my house.I'm disabled, MS secondary progressive, and a wheel chair user and live by myself.

    The windows at the front of my house only open at the top so I contacted a local firm who state they can do everything online and there's no requirement to visit the store. This is good for me as I've not left my house for a long time.

    I emailed the firm to say I wanted the windows replacing on my 3 bed semi and extension and porch, I included a picture of my house obtained from Google maps, I indicated on the picture how I'd like windows which could be opened from the bottom on the downstairs (wheel chair accessable) and from the side for the upstairs (I can't access the upstairs). I asked if it was possible to have 5 window panels in the longe/upstairs bay windows instead of the current 4 panels. They sent me a picture frame galley pdf of the new windows and the measurements - the upper part of the windows had a measrement of 450mm for the transom. I arranged for a surveyor to come and measure the windows. I recieved a price for this.

    A few days later after talking to people I decided to remain with 4 panels for the bay windows, the surveyor came out again to the measure the angles.We spoke about restrictor hinges on the bottom opening windows as I was concerned about how to use them and also security. My computer table where I sit is next to the extension window, he lent across me and opened the top window and used his tape measure to indicate the hinges, I told him I can't reach those windows he said it was just the show me the type of hinge which would be on thebottom part of thewindow and how it would have retrictors either side, he pointed roughly where the restrictors would be. As the extension window wall is lower than the bay windows I decided to have side opening windows.as having restrictor hinges on both sides of the window would make it too difficult for me to open, downstairs bay window will have simple hook an eye restrictors for the bottom opening. The surveyor had added all the measurement of the bay windows to his worksheet/contract and asked me to sign.

    Weeks later the surveyor, now installer, arrived to fit the upstairs windows and porch. After he finished the only window I could view w``as the porch window which i could see now had a larger upper part of the window. I contacted my sister to sk her to inspect the upstairs windows, she said they were the same upper window dimensions and what I know is a transom part is lower and in the line of sight and makes the windows of of proporton, she took several photos.

    The next day when the installer arrived I asked why the "transom" was lower on the windows, 450mm? He said they are the numbers on the contract I signed which he then gave me a photocopy of and he had indicated with his tape measure the new transom position, I said I never asked for larger top windows as I can't reach them from the wheel chair. He left as I said I wanted to know who had changed the measuremnt. I contacted the store who said I must have had a conversation with the surveyor - I didn't. Iasked about the 450mm measurement on the picture frame gallery and he said it was a guestimate from their app and the surveyor getts the precise measurements for manufacture.He wouldn't say anymore and said to contact their support by email. I emailed them and all they said is I signed a contract and there will be a late payment charge of 5%. I kept asking who decided the transom should be bigger, they wouldn't answer and filed a money claim.

    So, is the following correct, the windows has been made incorrectly? they should have been made so they opened from the bottom.

      I have a camera on my extension window sill which records motion. My converations with the insaller are recordered. The2ndvisit when he measured for the 4 panel bay windows was audio recorded - I audio record meetings with health visitors. I didn't record the 1st visit as my phone was on charge.

      I had a copy of the worksheet the installer used when measuring for 5 panels. I have it on video him measuring the transoms and writing it, 380mm. My son recentl visited me and he measured the windows in the extension and downstairs bay which hadn't been replaced and they are 380mm, the replaced porch is 450mm

      I gave a lot of evidence to the court and window company. I time stamped and typed the majority of what was said. I informed the window company I was disabled from the 1st email, the installer could see I was incapable of standing to reach the upper windows. In the court the judge was very, and I mean very, dismisive of my complaint of the differing window sizes. He said he had no idea what position the transom is in his windows and if an installer gave him different transom positions it wouldn't bother him at all.

      The director of the window company was in the court and he twisted everything to say they lowered the windows for my benefit. He said by having larger upper windows would mean the handle on the side opening window in the extension would be lower and easier to use. The 450mm tansom was already wriiten on the installers worksheet by someone else with different handriting to his, the last thing I decided was to change the extenson window from bottom opening to a side opening. I wassupposed to be able to ask the installer questions but the director butted in to answer for him. They falsifield screenshoot dates on the installers phone to indicate 450mm had been written on the 1st meeting. The director was talking to the judge aboiut uv levels and global warming and how glass expands and contracts etc, the judg asked how long he had the business, 25 years and he was impressed whereas I'm just a pleb in a wheelchair who has to pay 5% late payment and about £750/800 in charges.

        Are you thinking of Appealing the Judgement?

        You really should of asked CAB to help you with this.

        I think you needed to get an expert witness report from a disability expert to help you spell out the difficulties
        you face with the windows as they are. Also your evidence that they were given information so they would make
        them 'user friendly' because of your disability.

          The windows downstairs haven't been fitted apart from the porch window, I can't access upstairs its used if people stay. If the windows downstairs where installed I could use them but they are not what I wanted. All I hear is did you specify that you wanted the transom bar to be exactly the same level on the new windows? I didn't know what a transom bar was and that it could be in different position. Every semi where I live have matching windows/transom positions.

          When I contact the store the person said he was going to "scour" my emails to see where I asked for the transom to remain. Later on I asked if he scoured the emais he said yes, I asked did I ever mention transom or anything else about having different size windows....he told me to email the support team who reply back to say pay up.

          The judge said to the diector he could deliver but not install the frames or ask me to collect them and get a different person to fit them. I said I don't kow anyone who could collect and and fit. He then advised the director not to deliver. I have till next Friday to pay them

            How did you pay the deposit? Credit Card?

            It might be too late to go to any Ombudsman / associations schemes that they might be members of, are they members of any schemes?

            You could send them a SAR, to get hold of the information they hold on you, they have 30 days (so you can get copies of emails)

              I paid no deposit, I have to pay the full balance plus 5% late payment plus court fees by next Friday. I have a lot of inormation from camera, audio and the emails between myself and The Discount Window Centre, I didn't speak to anyone on the phone till the end as they said they could anything online which is why I chose them.

              I contacted CAB yesterday and they took some details but said te couldn't do anything but would pass on the Trading Standard

                Have you contacted Trading Standards directly?
                it might also be an idea to contact your MP see if they can assist.
                Also it might be an idea to seek help from Scope as they maybe able to provide advise and advocacy.
