  • Defendants solicitor issued N434 incorrectly

    I have issued an online claim and the day before the deadline received an email from gov.uk that the defendant has legal representation and I now have to deal directly with their solicitor via post and not online
    An email received from said solicitor, has a copy of form N434 which shows as me as the defendant and the defendant as the claimant
    Apart from the obvious I’m presuming this has been done to delay - I have not received notification of either N9A or N9B
    I also specifically chose the online procedure as I have problems with post and I am regularly in hospital - I do not want to correspond this way - guidance on gov.uk is that the post option is valid if the defendant doesn’t have access to online facilities but the fact the solicitor sent me notification via email , I’m presuming, contradicts this

    any advice gratefully received on how to proceed

    N434 is notice of change of solicitor. If acknowledgement of service has not been filed, then serving notice of change appears to be a mistake.

    You should carry on as usual.

    Take steps to ensure that any post received at your home address is brought to your attention promptly.
