  • Appeal to Circuit Judge being rendered nugatory by DDJ accused of bias

    I am experiencing intractable issues with apparent judicial bias and the deputy district judge involved seemingly scuppering my appeal behind the scenes. What can I do? I have filed an N161 notice of appeal requesting an interim stay and urgent interim directions, but that was almost three weeks ago and no directions have been forthcoming from the Circuit Judge, although I was told that my request was before him. Now the DDJ that I say was apparently biased, (he failed to declare his association with one of the parties), has issued a direction that I have to apply to him if I want a stay of his Order and make a separate application in N244. This, of course, means yet more court fees and legal costs in circumstances where I was entitled to make my application for directions on the N161. He has refused to recuse himself. It seems to me from the language that is now being used by the other party in the case, (publicly-funded), that the DDJ is drafting her correspondence behind the scenes because this correspondence now mirrors his own language, and, moreover, it appears that he has advised the party concerned to file a witness statement to the effect that my appeal is ‘totally without merit’ and that I should not be granted leave. What can I do to bypass this allegedly rogue DDJ? Worryingly, there is a costs hearing coming up in just over two weeks’ time in consequence of the Order I’m seeking to have set aside - his Order. My appeal bundle is due to be lodged the day after this. HMCTS contact centre blithely informs me that I can always ring up the day before the hearing if I need assistance!
