  • Issue of warranty of control

    I need some advice regarding debt with caboot finance and mortimer and Clarke solicitors
    today I recieved a letter from the business centre saying that a control of goods were been issued against me
    I contacted bailiffs via telephone as requested on the letter in response there told me to contact mortimer and Clarke solicitors about this because I wasn't aware of any judgement against me
    Contacted them to be told this judgement happened last year I told them I haven't recieved anything off the courts about this there response was there tried to send me it by post which I didn't recieve
    There have basically made me set up a payment plan to pay the money
    I asked for the agreement and data on this account and there said there don't have it
    Any advice on what I can do

    Welcome to LB

    Send the original creditor a Subject Access Request, make sure you get Proof of Postage.

    They will send you all the data they hold on the account.

      Thankyou for your help would the original creditor been the one that sold my debt on to Cabot in the first instance or would I need to send them a letter also

        I really don't know what to do I feel like I dunno where to turn especially now there have bullied me into making a payment plan to stop the bailiffs

          Yes the original creditor.

          Update the thread when you get and have gone through the data they send you.

              If you didn't receive the Court papers, then you can make an application for set a side, but you need evidence.
