  • Is this notice of change invalid?

    I have received a "Notice of change of legal representative" (N434) form just prior to a pending hearing.

    The change is not actually a change of legal representative, as it is the same firm, but with a new address.

    Besides that, the main error is that although they are the representative for the Claimant, they have incorrectly put their client as the defendant and named the defendant as the Claimant.

    Are there any potential consequences to them for this type of error or not?

    Check Box B on the form
    The form may read that the solicitor is representing you which is wrong
    You should email both the solicitor and the court, pointing out the error
    Write "Urgent" in the email subject heading
    If the solicitor hasn't provided their email address on the form, you should write a tetter

      The form N434 should not have been used just for a change of address. It is used for a change of legal representative as the title of the form suggests
      A simple letter "Re: Notification of Change of Address", sent to the court and all parties, would have been sufficient

        I am more concerned about them incorrectly mixing up the Claimant and defendant
