  • part 8 claim

I have received part 8 claim from private company who trading without my consent transfer the lease to their name.myself and owner of the trading company we both are personal lease holder for commercial property. we both have same rights to trade equally.

i have sold business in 2022 to the 2nd leaseholder and put him on the lease with consent of landlord so new lease were formed in 2022.

the 2nd leaseholder (owner of the company ) didn't paid the and i took them to the court after 2 years long battle i won now the defendant(the company) is defaulted in court judgment and i have taken enforcement .

They changed lock using commercial property as a residential (renting office room for staff to live in there) and are not letting me trade .
and now they issue part 8 claim for me transfer the lease.

there are no agreement for transfer the lease between myself and the claimant (the company) .

the landlord has objection that lease can not be transfer but they still went to court. The were trading 3 years without my consent .

i want to trade but they are getting aggressive and abusive every time i have visited the property and not letting me in at all.

what will be my course of defence.?

i have attached their particular of claim.

    Feb 25, Doc 3.pdf

    Thanks in advance .

Your best course of action is to consult a solicitor.
