  • Appealing Magistrate Court Sentence

    Hi,

    I am appealing a sentence from a Magistrates Court and I have a couple of questions about the form:

    'Appeal to the Crown Court at:'

    Is this any Crown Court, as in the one closest to me, or is there a specific court this must go to?

    Next one:


    'Send the completed form to the magistrates’ or youth court office AND send a copy of the completed form to the prosecutor’s office.'

    Is this the Magistrates Court where the sentencing took place?

    Last one (and I appreciate this might be quite a big question):

    'I want my application(s) considered by
    the magistrates’ court the Crown Court'


    Is going back to the Magistrates Court best and only go to the Crown Court if I really need to?

    Not sure about the wording on the form but I sit as a Magistrate on appeals in the Crown Court and they are heard by 2 magistrates (not involved in original decision) and a judge.

      The big question is, where do i send this form to? Does it go to the original magistrates court or is there a particular crown i must send it to?

        The form seems to suggest to crown but I would ring the mags court and ask
