  • Statement of Case - Proceedings referred First Tier Tribunal Property Chamber

    As Respondent I am required to prepare a statement of case for a forthcoming FTT hearing.

    Can anyone help me with a template draft I can work from / adapt to suit?

    The background is a claim for alleged service charge arrears disputed.

      In case you haven't found the document, please read "The Tribunals Procedure (First-tier Tribunal)(Property Chamber) Rules 2013" at
      www.assets.publishing.service.gov.uk
      Point 30 The response on page 21 provides details of what the respondent's response must include, when and where it must be sent
      Head the document "The Response"

        Thank you Echat11 / Pezza54.

        As a point of clarity I filed a defence to the claim long since.

        That claim has been referred to the First Tier Tribunal (Property Chamber) who have required me to deliver a Statement of Case setting out what I dispute, precisely why and on what grounds by month end.

        Had no luck with securing representation to advance this and now only have two weeks to deliver the SoC.

        Is there a draft that’s property-related that I could work from whilst I try and get a property litigation expert to handle if for me?

        Don’t want to fall foul of processes and protocols I know nothing about but the legal fraternity will.

        Help appreciated

          Has the tribunal asked the claimant/appellant to submit an application notice?
          Your statement of case was your defence to the claim in the civill court that you filed months ago

          You should be sending the tribunal your response to the application notice

          Are you able to post the letter \(names and addresses redacted) you received from the tribunal

            You should prepare a document in plain English, using your own words.

            Take the claim against you item by item.

            In respect of each item say whether you agree it or dispute it.

            For each that you dispute, say why. If you are putting forward an alternative figure, with reasons.

              Also, you may find it helpful to read this, about "Scott Schedules" - https://www.justice.gov.uk/courts/pr...-schedule-note. I have an idea that the judge may be wanting to take this approach to this case.
