  • Recover money from builder for default works

    I have been doing a major building work of 5 flats and paid the builder 300k in different phases of works. The actual work done was only £240k as per the builder's statement. The builder stopped working for four months which is costing me pay interest on the development finance and still unable to complete the work. Can I sue the builder and if yes, what all costs can I claim against him? Is the small claims court to go or should it be the county court? I have the builder signed agreement with agreed price with all evidence of payments made against the works... Pls advise.
