  • CCJ Help please

    Hello,

    I have only just discovered a CCJ was registered to me upon checking my credit file last week. The CCJ was registered on the 27th June 2023 in the amount of £110.

    I have managed to find out who it’s from.
    I have been in contact with them and explained that I never received their invoice or any claim form. They state they sent this via post - no attempt to email (informed them in 2021 this is my preferred contact method), telephone or send mail via recorded delivery. They have said they’d consider consent to remove if I pay it. However, I know once I’ve paid it it’s then admitted and satisfied so I’m reluctant to do so just yet.

    I understand it’s unlikely I can have it set aside purely for the fact I didn’t receive the letters and claim form, they do have the corrrect address for me. However, they have spelled my first name incorrectly (slightly)- would this have any impact?

    They tried to register a CCJ against me back in (I think 2021) and I received the claim forms which I submitted to the courts and it was upheld. I’ve basically had the same problem before where they don’t communicate with me and suddenly register a CCJ, on that occasion I was able to defend however as I did receive the claim form.

    One last thing. The account itself is in both mine and my husbands name. However, it’s only myself that has received the CCJ, nothing for my husband. They also didn’t post anything at all out to him.

    I would just like to find out what my options might be at this stage or whether I should simply pay this and accept my credit file is ruined for a few years.

    Hello,
    If you pay it and they consent to set aside, it is removed from your file entirely. If you pay it but they dont consent it is satisfied. I would strongly advise you pay and apply to set aside with consent so it can be removed from your file.
