Consent order signed but CCJ is old. Mortgage worries looming.

  • Consent order signed but CCJ is old. Mortgage worries looming.

    I am in the process of buying a house and a CCJ on my credit report (Registered in 05/2021 and satisfied in 06/2022) is causing issues...

    The CCJ was with a parking company and rather than typing out the details, here is the email I sent to them recently in dispute:

    ''' In short, I was issued a parking fine some time ago in 2019 by the company looking after the car park at Ibis Heathrow. I'll save you the full details but I was told by staff 'not to worry' about paying because at the time, the machine was down in reception.

    I received the fine, disputed, but this wasn't responded to. I believe the claim then got passed on to you guys at Ce-Service. I then disputed again. Again, after some time, I saw a CCJ on my credit report but this was 3+ months after it was filed. So, I had no chance in disputing.

    As I now understand, I did pay the CCJ. The payment was made on July 16th 2022 (According to TransUnion but I believe it was much earlier. This was just the settled date).

    It was then in 2023, nearly a year later that this was reported to the courts by ce-service...

    Now, being honest, I am in the process of applying for a mortgage and this is something I feel I should give attention to... I was going to file a N244 but have come to learn I can also look to get a consent order from yourself.

    With this CCJ being paid and the ordeal with the hotel in the first place, would you be willing to have this settled so I can remove the CCJ from my report? I appreciate it's been some time since this happened but, it's only since starting the home-owner process I realise what a crux this is. '''

    Off the back of this, the company has agreed and signed a consent order to remove the judgement.

    I now have to apply to the courts with my reasons.

    With the consent order signed by the claimant, is it worth sending to the courts or will this get thrown out?

    I know the CCJ falls off soon but I am moving out in the next few months regardless and not having this would be helpful...

    Appreciate any feedback at all!

    If the claimant agrees, there is a fair prospect of the court agreeing to your application to set aside judgement.

      I would be concerned about the amount of time that has elapsed since the judgement date (May 2021)
