  • Set Aside Case - Who Pays

    In a set aside case, can the court order the Claimant to pay the court fees for the Defendant if the set aside is success as it is not allocated to a track yet?

    It can, but whether it will is another matter.

        When the judge decides that it is the right order to make, probably in that the claimant is in some significant way at fault.
