  • Mortimer Clarke

    Good afternoon,
I wonder if anyone could help me please.
I had am Mbna credit card from 2000.
Fast forward to 2005/6 when I got behind with my debts and I did get a couple of ccjs.
I was paying them for a while, in 2015 my home was repossessed after I lost all my close family members within a few years and was off work with depression.
I moved into rented accommodation and was always on the voters roll.
In 2001 Mortimer Clarke started contacting me about an mbna credit card I had for 1100, asking for payment stating they had a ccj.
I'll be totally honest I was in such a mess years ago, that I can't recall who got the ccjs.
So I asked them for info on this debt. They told me they'd got a ccj 2006 and a charge on my property, a claim number was provided.
I can't remember this happening, I no longer have the property, but they keep sending a company called Engage out to my home and state they have a charge on my home and I need to start sorting this out etc.
I'm just worried what they can do now with the ccj, can they enforce this in other ways now and what's the best thing for me to do.
Many thanks in advance for any assistance.

If the creditor has a CCJ, then they would need to go Court to follow through on the CCJ.
They would need a very good reason why it's taken them so long to enforce the CCJ.
If there was a charge on the property, it would be 'impossible' to sell.

I would be tempted to send the following letter to Engage, see how they respond, make sure you get Proof of Postage.

        Thank you Echat11
I wasn't sure if the charging order would class as enforcing the ccj, even though it was over 15 years ago.

If your in rental accomodation they can't have a charge on it.

That is a fact, but not relevant if you read the OP's post.

I see now that OP meant a charge on his old home, however if that is reposesed then they don't have a charge on it.
