  • How to send a letter before action with no address or email?

    I have purchased a vehicle from an individual which after 2 days is found to be faulty and also to top it off he did not have his version of the V5 log book so I am not the registered keeper until the V62 comes through which can take 6 weeks. I got 3 months warranty but can not drive it to be repaired without tax as the vehicle is not taxed. I asked him and have a recording of the conversation asking for his business address to which he replied he does not have one to give so he can not give me it. I tried asking for any possible address or even an email to which he declined to give but I have many numbers for him. One attached to auto trader chat, his personal business number to which he answers it by saying the business name and also another number he whatsapped some images to me for the V62 confirmation sending at the post office. Essentially if this escalated enough I plan to send a letter before action for refund of the vehicle and to take ownership back as its not satisfactory and also I am without a vehicle until the V62 comes through. If he out right refuses to give any address or email can I text every single number I have for him including whatsapp as it will tick when its read my letter before action and could that be seen as me trying every possibility to get details of the address with the call recordings? Right now these are just queries for now to wrap my head around it.
    Also he is not registered on Companies house and the Invoice has his name (if its his real name) and company name but no address

    Well your first step will need to be finding an address. There's no point sending a LBA until this stage.

    You'll need to look up his address on autotrader (if its there?) or find other ways of finding it sadly.

    Your other option would be to pay a tracing service, although you will likely need several pieces of personal information for this.

      Unfortunately the address on there is just a street name and post code but it has no number or business name. So I am really having a difficult time here as we met at the train station I have his banking details, business name but there is no registered business and his name on Facebook. How does a tracing service work?

        Go knock on a few doors and ask if this is the right house for [name].

          you mean you have his bank details? Sort code acc number and bank name?

          If so you can just put the name, street and postcode on envelope
          if undefended you can then get a CCJ then a charging order.

            That is NOT a method of service permitted under CPR Part 6.

              sorry but letters of claim don't have to comply with CPR part 6.9 that's only for the cclaim form

                      Nothing comes up for the business but for the names I have some details but how do I know if they are correct as I said he could of gave a fake name.

                        I have now acquired an email so if I genuinely failed to get an address could I email it as he's using this email for trade?

                          You have a name, a street and a postcode from various sources that he has supplied.
                          From 192.com you obtained the rest of the address

                          If it's not he, then someone will have a surprise when they receive your Letter of Claim.(don't send it recorded.. just a free certificate of posting from PO)

                            as to whether the name is correct, I think it unlikely that the bank account will have been opened under a false name, given the checks banks have to make.

                              So if I sent the LBA letter to these addresses I found and they are incorrect what happens then?
