Need help with County court claim received

    Hi echat11 ,

    They said they sent the cca on 27th nov but i didnt receive, mediator asked them to send via email which theyve done. looks official but not sure, has credit limit, my name address date, interest etc on it. Doesnt look generic

    theyve said they will take settlement today by installments, but if i dont agree to this in mediation they will not allow for installments again in future.
    Should i make an offer? Mediator will call me back in 10 mins once ive had chance to review the docs

      Hi again echat11 ,

      I offfered 10% in full or 20% in installments per month, both were rejected and their counter offer was around 60% of the balance which i turned down.

      The case will now be transferred to home court the mediator said, and if i've not heard anything within 3-4 weeks to contact the court.

      Can I share these docs theyve sent to me with you to make sure they're all in order? The solicitors said i can offer outside of mediation, but they will onlly consider for installments in mediation which has now ended, so now option is only to pay in full.

          How old is the account?

          Are there any reference numbers at the bottom of the CCA?

          That's ridiculous, if a Hearing took place and you sent in an I & E form, and could only pay £20 a month, that's all the Court would order you to pay.

                  Reason I ask as a CCA that was provided to me in my last post (diff claim thread) was a template that didnt have any of my details in it at all, id be reluctant to make an offer based on that as it shoudlnt stand in court, but with this one, how are the courts to know if its a populated template vs the original?

                  Not really sure what to do now.. thanks as always.

                    It's not unusual for 'Mediation to not resolve the matter. So nothing lost in trying.

                    What I would say, they didn't send you when you requested the CCA, they spring a CCA on Mediation day (looks good, but is it good), they try to restrict your options i.e. installments now or never etc. Seems strange to me.

                    a) would the courts be able to identify a populated template vs an original cca?

                    Not unless there was another one to compare it too.

                    b) how can i validate this?

                    Try Google, Images, CCA, Lending Stream etc.

                    c) know you dont really offer official advice, but based on the above, what would you be looking to do, settle, pursue and fight it?

                    You don't need to rush into a decision now. Go through CCA (these tend to have the year and version at the bottom, LS might be different, but lets see) Default and Notice Letter of Assignment. Post an update early in the new year, we can look at what you have.
